1. About these Terms
These Terms and Conditions govern access to and use of xfundit.com, my.xfundit.com, the xFi Client Portal, xFi Trading Hub and related xFi website features (together, the “Services”). By creating an account, signing in, or continuing to use the Services, you agree to these Terms.
These Terms govern website and portal use. Any live trading account, financial product, order execution, funding relationship or other regulated financial service is also subject to the separate Client Agreement, risk disclosures, product specifications, execution policies and other documents presented for the relevant xFi contracting entity. Where those documents conflict with these Terms on a trading or financial-services matter, the applicable Client Agreement or product document prevails.
2. Eligibility and lawful access
You must be at least 18 years old, have legal capacity to enter into these Terms, and use the Services only where doing so is lawful. Products, platforms and account features may not be available in every jurisdiction. You are responsible for complying with restrictions that apply to you.
3. Account registration and security
You must provide accurate information, keep it reasonably current, and protect your passwords, verification codes, trading credentials and devices from unauthorised use. Master trading passwords may permit trading; investor or read-only passwords are intended only for viewing where supported. You must notify xFi promptly if you suspect unauthorised access.
xFi may use email, mobile, device, network and security checks to protect accounts, verify instructions and investigate suspicious activity. You remain responsible for activity carried out using valid credentials until xFi is notified of a compromise, subject to applicable law and the applicable Client Agreement.
4. Identity verification and records
xFi may request identity, address, contact and source-of-funds information to meet onboarding, fraud-prevention, security, legal or compliance requirements. Documents you submit must be genuine, current and belong to you. xFi may place an account under review or restrict access while suspected duplicate, altered or inconsistent information is investigated.
Submitted documents, acceptance records and administrative review records may be retained for legal, regulatory, security, dispute and record-keeping purposes in accordance with applicable law and xFi retention policies.
5. Trading platform and market information
Prices, charts, market data, symbol specifications and other trading information may be supplied by third parties or connected trading infrastructure. They may be delayed, interrupted, indicative or different from executable prices. A displayed quote does not guarantee that an order can be executed at that price.
Demo accounts use virtual funds and do not represent cash, deposits or withdrawable value. Live trading functionality is available only when the relevant account, server and execution arrangements have been activated under the applicable Client Agreement.
6. No investment advice and trading risk
Website, portal, terminal, educational and market content is provided for general information and platform use. It is not personalised investment, legal, tax or financial advice and does not guarantee any result.
Leveraged products, including foreign exchange and contracts for difference, can result in rapid and substantial losses. Leverage can magnify both gains and losses. You should understand the relevant product, margin, fees and risks and trade only with funds you can afford to lose. Separate risk disclosures may apply to your account and jurisdiction.
7. Funding, withdrawals, promotions and credit
Deposits, withdrawals, internal transfers, promotional credits and bonuses are subject to the payment methods, account rules, verification requirements, limits and promotion terms displayed for the relevant service. A payment screenshot alone is not proof that funds were received. xFi may require transaction verification before crediting an account.
Promotional or bonus credit may be non-transferable, non-withdrawable and subject to separate conditions. Cash and credit may be recorded separately. Where a transfer or withdrawal affects a promotional account, the applicable bonus terms may provide for a proportional reduction or cancellation of credit.
8. Acceptable use
You must not misuse the Services, attempt unauthorised access, interfere with security or availability, upload malicious code, impersonate another person, submit false or fraudulent information, abuse promotions, or use automated extraction or reverse-engineering methods except where expressly permitted by law or by xFi in writing.
You must not use the Services for money laundering, sanctions evasion, fraud, market abuse, unlawful activity, or conduct that breaches an applicable Client Agreement. xFi may investigate suspected misuse and take proportionate protective action.
9. Intellectual property
The xFi name, logos, software, interfaces, website design, text, graphics, databases and other materials are owned by or licensed to xFi or their respective rights holders. You receive a limited, revocable, non-exclusive right to use the Services for your own lawful account activity. No ownership rights are transferred to you.
10. Service availability and third parties
xFi aims to keep the Services available but does not promise uninterrupted or error-free operation. Maintenance, network failures, market disruptions, third-party providers, browser or device limitations and events outside reasonable control may affect availability. Third-party services remain subject to their own terms and availability.
11. Your content and communications
Information, documents, files, messages and other materials you provide remain your responsibility. You grant xFi the rights reasonably necessary to receive, store, review, transmit and process them for account operation, support, security, fraud prevention, compliance and record keeping. Personal data is handled subject to the applicable privacy notice and law.
12. Suspension and termination
xFi may restrict, suspend or terminate website or portal access where reasonably necessary to protect security, comply with law, investigate misuse, respond to a material breach or maintain the Services. Trading-account suspension, close-out, order handling and financial consequences are governed by the applicable Client Agreement and product terms.
13. Disclaimers and liability
To the maximum extent permitted by law, the Services are provided on an “as available” basis. xFi does not guarantee that website information will always be complete, current or free from errors. Nothing in these Terms excludes liability that cannot legally be excluded.
To the maximum extent permitted by law, xFi is not responsible for indirect or consequential loss arising solely from website or portal unavailability or reliance on general website information. Liability arising from trading, execution, custody, payments or regulated financial services is determined by the applicable Client Agreement and mandatory law.
14. Changes and electronic acceptance
xFi may update these Terms to reflect changes in law, security, technology, products or business operations. Each published version identifies its version and effective date. Where required, material changes will be brought to your attention. Your acceptance is recorded electronically with the applicable terms version, date and security information.
15. Governing documents, law and disputes
The contracting entity, governing law, dispute process and regulatory information applicable to a live trading or financial-services relationship are stated in the relevant Client Agreement and legal disclosures provided during onboarding. Those documents control for the matters they cover. If you use only the website or portal and have no Client Agreement, contact xFi Support for the entity and legal terms applicable to your jurisdiction.
